ZONING BOARD OF APPEALS MEETING AGENDA        JUNE 15, 2023     7:00 P.M.

  1. Approval of the Maty 18, 2023 meeting minutes
  2. David Fried and David Schwartz – PUBLIC HEARING–2 and 4 Belvedere Path–40.19-1-61/60       Joint application of David Schwartz and David Fried, property owners of 2 Belvedere Path and 4 Belvedere path respectively, which was submitted to the Village of Montebello Zoning Board of Appeals for a variance for: Minimum Lot size, 2 Belvedere Path [existing non-conforming 33,017 sf, required 50,000 sf, proposed 29,753 sf] as per Section 195 Attachment 2, row h, column 2 of the zoning code of the Village of Montebello. The Applicants propose a subdivision lot line shift that would convey 3,264 sf from 2 to 4 Belvedere Path to bring the existing koi pond area entirely onto one property.  The parcels are located on the north side of Belvedere Path west of the intersection of West Gate Road and are identified on the Ramapo Tax Map as Section  40.19 Block 1 Lots 61 and 60  in Zone RR-50.  THE APPLICANT LAST APPEARED BEFORE THE BOARD ON MAY 18, 2023.  THIS IS A PUBLIC HEARING.

Mendy Kempler–213 Spook Rock Road–49.13-1-4      Application of Mendy Kempler, owner of 213 Spook Rock Road, which was submitted to the Village of Montebello Zoning Board of Appeals for variances for: Total side setback [required 75 feet, provided 56.80 feet]; side yard [required: 25 feet, provided 0 feet]; side yard [25 feet, provided 6.83 feet]; and side yard [required 30 feet, provided 17.10 feet] as per Section 195 Attachment 2, row h, columns 6, 7 and 8 of the zoning code of the Village of Montebello for a proposed addition to a single-family dwelling. The parcel is located on the east side of Spook Rock Road, 10 feet north of Topaz Court and is identified on the Ramapo Tax map as Section 49.13 Block 1 Lot 4 in Zone RR-50.  THIS IS THE FIRST APPEARANCE BY THE APPLICANT.
  4. Yitzchok Zelcer–14 Fant Farm Lane–49.17-1-2.11–PUBLIC HEARING       Application of Yitzchok Zelcer, owner of 14 Fant Farm Lane, Montebello, NY which was submitted to the Village of Montebello Zoning Board of Appeals for variances for: Rear yard to pool (water’s edge) [required 30 feet, proposed 20 feet] as per Section 195, attachment 2, Row t, and Section 195-57D of the zoning code of the Village of Montebello for the construction of an in-ground pool for an existing single-family home. The parcel is located on the west side of Fant Farm Lane approximately 1600 feet north of the intersection of Spook Rock Road and is identified in the Ramapo Tax Map as Section 49.17 Block 1 Lot 2.11 in the ER-Zone.  THE APPLICANT WAS LAST BEFORE THE BOARD ON APRIL 20, 2023
  5. Simon Ganz–3 Sycamore Lane–49.05-1-29       Application of Simon Ganz on behalf of 3 Sycamore Lane LLC, owners of 3 Sycamore Lane, Montebello, NY, which was submitted to the Village of Montebello Zoning Board of Appeals for a variance for:  Development coverage [maximum 20%, proposed 23%] as per Section 195, Attachment 2, Use Group h of the zoning code of the Village of Montebello for the construction of a circular driveway.   The Parcel is located on the west side of Sycamore Lane approximately 350 feet north of the intersection of Viola Road and is identified on the Ramapo Tax Map as Section 49.05 Block 1 Lot 29 in the RR-50 Zone.  THIS IS THE FIRST APPEARANCE BY THE APPLICANT.
